About this policy
Hi, we're Envato and welcome to our Fair Use Policy. This policy applies to all users of Envato Elements, Envato Market, Envato's AI Tools and any other Envato platforms, tools or sites which reference this policy in their user terms (Envato Sites). It sets out some rules and guidelines in relation to your use of the Envato Sites, and the items, assets and other content (including content created by you through our AI tools) on those sites (Content) that are available for you to download or generate, and use as part of your projects.
This policy, which supplements and forms part of the user terms for each of the Envato Sites, is designed to keep things running smoothly and ensure responsible, creative, fair use of the Envato Sites for everyone in our creative community.
Please check your plan details for information on any limits which are applicable to your plan. Where there are defined limits in your plan, we generally rely on the plan limits themselves rather than enforcement under this policy. However, attempts to bypass or manipulate these limits will be dealt with under this policy.
So what's not fair use?
You must only generate or download Content when you have the intention to use them.
It is a breach of this policy and the user terms for each of the Envato Sites to generate or download Content that you do not intend to appropriately use, to use scripts or bots to mass generate or mass download Content, or to generate or download excessively high volumes of Content in a short amount of time, including but not limited to generating or downloading Content for fraudulent purposes, via individual account sharing, or generating or downloading Content in advance in order to use or “stockpile” the Content after your Envato Elements subscription or other right to use the relevant Envato Site is over.
Remember, on Envato Elements, your license to use an Envato Elements item is on a per-project basis and you can only create new licenses for items while you have an active Envato Elements subscription. If you want to use an item in multiple projects, you need to create a new license for each new project the item is used in.
What will happen if a user engages in inappropriate, excessive, unusual or unfair activities when downloading or generating Content?
In addition to our rights under the user terms for the Envato Sites, we reserve the right, at our sole discretion, to restrict or terminate access to any Envato Site for any user (whether or not they are a subscriber) if Envato, at its sole discretion, has reason to believe that the user’s activities on the Envato sites suggests inappropriate, excessive, unusual or unfair use patterns in generating or downloading Content, including where we notice high volumes of Content being generated or downloaded by that user in a short amount of time. We may do this immediately, without notice or liability and without affecting any other remedies available to us.
Depending on the way you use the Envato Sites, you may have a genuine need to generate or download high volumes of Content. We will remove any imposed generation or download restrictions once we are satisfied that a user is not engaging in inappropriate, excessive, unusual or unfair behavior when generating or downloading Content. For users on plans with defined AI or other limits, we generally rely on the plan limits themselves rather than enforcement under this Fair Use Policy. Attempts to bypass or manipulate these limits will be treated as a breach of this policy.
To establish this, we may contact users to understand more about their use of the Envato Site instead of (or as well as) restricting access. If you are on a plan without defined limits and have a need to generate or download high volumes of items, especially within a relatively short amount of time, we encourage you to contact us in order to show proof of legitimate use of the Content - this will reduce the likelihood that your download behavior will trigger action under this policy.
If we detect behavior which we determine, in our sole discretion, is suggestive of inappropriate, excessive, unusual or unfair generation or downloading of Content, then we may take action to protect us and our authors and investigate potential breaches of this policy and/or the user terms for the applicable Envato Site.
