When we receive claims about unauthorised use of content on Envato Elements, depending on the circumstances and who has made the claim, we can apply the DMCA law and our processes for other content as already explained.
We will always try to work with everyone involved fairly and in the spirit of our community. Unfortunately we can't help you by giving you legal advice. We can't make legally binding judgments either as we are not a court of law!
Envato Elements acts as a reseller for the independent designers who contributor content to our subscription. These contributors have been carefully selected and given clear guidelines on their legal obligations, including the need to respect the intellectual property of others. We conduct regular quality checks as per our ongoing library management activities, however please be aware that contributors can publish items directly to the site without our prior approval.
It’s for this reason that you should not assume that we have checked all content for the existence or ownership of copyright. If we’ve published content on Envato Elements, it does not necessarily mean that we have checked and cleared copyright or other intellectual property rights.
As soon as we become aware of any infringing items, we act promptly to remove the content, and then to educate, caution or remove the contributor responsible.
